When you order and download an image file on itsoutnow.co, you will encounter one of the following three licences incorporated into the acquisition process. By proceeding with your order, you indicate you have read and agree with its terms. Below, you can review the contents of the different licenses.
By internationally recognised copyright law, you understand and acknowledge that the creator of an image retains copyright no matter who commissioned the capture or whether you've purchased the file. You can acquire copyright through a mutual, written agreement, usually for further consideration. However, your ability to use images is activated through licences which is attached to the file

This licence applies to organisations, both profit or NFP, for image files you use for broad editorial & general purposes in print & digital media.
VALUE-ADDING USES
However, note that using the image for higher value-adding purposes attracts a surcharge of 50%. Contact info@itsoutnow.co to enquire about extending this licence.
Value-adding uses refers to applying images to branding, logos, advertising campaigns, book, magazine and album covers, or signature images on product ranges.
FOR BROAD EDITORIAL AND GENERAL USES
In return for your payment or consideration, we grant you a license to apply the enclosed electronic image for all broad editorial and general purposes.
Under this license, you may commercially exploit the image by doing the following things, and no other things:
* Make copies of the image
* Apply across print and digital media
* Distribute copies of the image
* Use the image to make derivative works
STRICTLY ON THE FOLLOWING CONDITIONS:
* You do not use the image as a trademark, significant branding or for advertising campaigns without paying a 50% surcharge
* You do not make electronic copies accessible to other persons – including as an extractable part of any electronic file (e.g. Word document)
* You always attribute any copy of the whole image as follows: " itsoutnow.co "; and any derivative work must include that attribution
* You do not use the work in a derogatory way
* You do not otherwise infringe the copyright in the image
THIS LICENCE IS:
* Periodic license fee and royalty-free – no ongoing payments whether used to commercial purposes or otherwise
* Worldwide – no territorial restrictions
* Ongoing but revocable – continues indefinitely, but we may revoke it and will notify you if we do revoke it
* Non-exclusive – we can grant the same rights to others
* Non-sub-licensable & non-assignable – you cannot grant or transfer your license rights to any other person or organisation.
Reference to "image" in these license terms means part or all of the image.
2: Lo, med-res download, for performers & models
Digital files available to performers and models who have participated in itsoutnow and PhotoTeam Pty Ltd initiated shoots and projects.
SELF GENERATED DIGITAL USES
Following your consideration, payment or in-kind transaction, itsoutnow.co and PhotoTeam Pty Ltd grant you a licence to use the lo and med-res files of the image in the following ways.
You may broadly use the image in all communication and promotional activities that either you and your production company undertake and disseminate yourselves. You should not apply the image in print (eg posters and programmes) without further agreement with PhotoTeam (or itsoutnow.co).
• You may apply the lo and med-res files to digital media only
• You may include them on personal blogs and social media accounts, your websites, and use for direct email mailouts
• You may specifically use the image files in personally-produced professional profiles and folios to promote your career and capabilities to such parties as agents, producers and festival organisers
• You may supply the image to not-for-profit organisations and festivals (such as Edinburgh and Adelaide Fringe) to facilitate online listings and other electronic promotional activities related to your production.
ADDITIONAL USES
All other requests for additional uses by third parties, including professional theatrical producers, commercial and private sector festival organisers, and public relations professionals, should be directed to PhotoTeam Pty Ltd for broader licensing, which may include additional fees. SPECIFIC RESTRICTIONS
• The image should not form part of a trademark without further agreement with PhotoTeam
• You should ensure that third parties that require access to the images to fulfil your requirement (e.g. graphic and web designers), they should only apply the images to the activities you have engaged them for.
• You should ensure that any image file posted on web and blog sites is protected from user download (e.g. by right-clicking or drag and drop)
• When and where ever possible, you should ensure the images is attributed to " itsoutnow.co"
• You do not otherwise infringe the copyright in the image.
THIS LICENSE IS:
• Royalty-free; with no ongoing payments
• Valid for five years from the date of capture and is nonexclusive
• Revocable— and if we do so, we will notify you.
• Worldwide - no territorial restrictions.
• Non-sub-licensable & non-assignable— you cannot grant or transfer your license rights to any other person.
A reference to "image" in these license terms means part or all of the image.
This licence applies to subjects of public photoshoots and commissioned coverage of designated events.
Your rights to the usage of the images are activated by way of this license.
By purchasing or acquiring these files, PhotoTeam grants you a license to certain rights of copyright in the enclosed electronic image.
USES
Under this license, you are authorised to do the following things and no other things:
* You may apply the images digitally, e.g. posting on social media, websites, EDMs. and emails
* You may not apply them in any print media, e.g. posters, photographic prints, publishing activities
YOU MAY
* Distribute copies of the image via email and message apps and over social media.
* Post on websites.
* If you have acquired a watermarked image, you should ensure that the watermark remains visible whenever you use
* If file does not include a watermark, you should ensure wherever possible. that you credit the image to "itsoutnow.co"
STRICTLY ON THE FOLLOWING CONDITIONS
* The image must not be used as a trademark and any derivative works must not be applied commercially
* You do not use the work in a derogatory way; and
* You do not otherwise infringe the copyright of the image as legally understood.
THIS LICENCE IS
* royalty-free; ie no ongoing payments;
* worldwide - no territorial restrictions;
* ongoing but revocable; ie it continues indefinitely, but we may revoke it and will notify you if we do;
* non-exclusive; We can grant the same rights to others; and
* non-sub-licensable & non-assignable; You cannot grant or transfer your license rights to any other person or organisation.
